The latest
On July 1, we will be going to court to argue our position against the City. The trial, which is also known as a “merits hearing,” will address the merits our claims against the Housing Element and the City’s argument that the action was not timely filed. We need the judge to agree with both of our positions (that is, we are timely and our objections have merit) for us to be successful. The court session will be completed in one day and then the judge will decide. We may not know his decision for several weeks. As soon as I know the answer, I will communicate it with you.
In the past week, the State has preliminarily “accepted” the County’s latest RHNA proposal (their third). The County still must jump through a series of hoops to implement it, but it appears to me that these steps are more administrative than not—they focus on zoning, an environmental impact report, and formal adoption of the housing element. Unfortunately, Tarpy Flats remains on the plan. We will have our opportunity to send our comments to the County and object to their proposed development. This is a necessary step for us to raise our concerns later. I will let you know when and how to file your comments with the County when the time comes. We may need to serve the County with a notice of deficiencies once the housing element is adopted and even file a suit against the County if corrections are not made.
In addition to the state’s reasons, we feel the new development proposed for Tarpy Flats would be at odds with the county’s community wildfire protection plan drafted in November of 2010 and updated in 2023.

We obtained a Wildfire Threat Analysis from dbHillman Consulting & Investigations and a Wildfire Evacuation Estimate Study from KDL Associates in regards to the Tarpy Flats Area.
